INVITATION TO SUBMIT BIDS ON REAL ESTATE
NOTICE TO BIDDERS NO. 3-05
Notice is hereby given that pursuant to I.C. 36-1-11-4, the Board of Public works and Safety of the City of Gary, as the designated disposing agent for property owned by the City of Gary, will receive and consider written bids for the purchase of certain real estate in the City of Gary, Indiana, hereinafter described, subject to the conditions of sale hereinafter set forth.
[Lots 1 to 15, both inclusive; and 38 to 52, both inclusive, in Block 7 in Gary Land Company's Tenth Subdivision, in the City of Gary, as per plat thereof, recorded in Plat Book 20, Page 33, in the Office of the Recorder of Lake County, Indiana, together with the 20 foot vacated alley lying East and adjoining said Lots 1 to 15, both inclusive, and lying West and adjoining said Lots 38 to 52, both inclusive;

The subject site consists of a rectangular shaped, corner parcel of land with frontage of approximately 375 feet along the east side of Broadway, frontage of approximately 260 feet along the south side of 13th Avenue and frontage of approximately 375 feet along the west side of Massachusetts Street. The subject site contains a total of approximately 97,500 square feet or 2.24 acres, more or less. Access and visibility are excellent and utilities are available to the site.
APPRAISED VALUE - $142,000.00
Written bids for said property will be accepted at the office of the City of Gary, Board of Public Works and Safety (Board), City Hall, 401 Broadway, Suite 300, Gary, Indiana, during the Board's regular business hours, beginning at 8:30 a.m. on August 29, 2005 and ending promptly at 10:00 a.m. on September 7, 2005. The bids will be opened upon receipt and promptly made available for public inspection. The bidder must specify the proposed use of the property in its bid. Every bid must contain a lump sum bid price for the complete property and the complete name, address, telephone number, and FAX number, if available, of the bidder. The sale of the property will be awarded to the highest and best bidder as determined by the City of Gary.
A bidder may raise its bid and that raise shall be effective after the Board, or its designee, has given written notice of that raise to the other bidders who have submitted bids by the time said notice is given.
Sale of real property owned by the City of Gary must be approved by the Mayor. In addition, any such sale of real property having an appraised value of over 50,000.00 requires the approval of the Common Council of the City of Gary. Before the approval of the Mayor and Common Council can be given, a Public Hearing regarding the proposed sale, for which appropriate notice is given in accordance with I.C. 5-3-1, must be held. The Mayor has designated the Board to give the appropriate notice, conduct the necessary hearing, and, thereafter, provide him with the Board's written recommendation.
All bids received will be read aloud at the Board's regularly scheduled meeting on September 7, 2005, which is scheduled to begin at 10:00 a.m., in the meeting room of the Board, 2nd Floor, City Hall, 401 Broadway, Gary, Indiana. In order for an offer to be considered by the Board, a bidder must be present at the Board Meeting, to be held on Wednesday, September 7, 2005; make a 15 minute presentation of their Proposal during said meeting; and answer questions from Board Members.
The Board of Public Works and Safety reserves the right to reject any and all bids, and to make an award to the highest and best bidder. In determining the best bid, the Board will take into consideration the size and character of the improvements proposed to be made by the bidder on the real estate bid on; bidder's plans and ability to improve real estate with reasonable promptness; whether the real estate, when improved, will be sold or rented; the bidder's proposed sale or rental prices; financial responsibility, qualifications, experience and ability of bidder to finance and complete the development; consistency of the bidder's plans with the Design Guidelines and other considerations. The Board of Public Works and Safety reserves the right to waive any informalities in bidding.
CONDITIONS OF SALE
1. Plans must conform to the Design Guidelines as outlined in the bid package or go to the City of Gary Department of Planning's web site at www.gary.in.us/planning
2. The property may not be sold to a person or the agent of a person who is ineligible to purchase the property pursuant to the terms of I.C. 36-1-11-16.
3. A bid submitted by a Trust (as defined in I.C. 30-4-1-1a) must identify each:
a. beneficiary of the Trust; and
b. settler empowered to revoke or modify the Trust.
4. The minimum bid for real estate offered for sale shall be ninety percent (90%) of the appraised value. The Board of Public Works and Safety may sell the property for less than 90% of the appraised value only after having issued an additional notice of sale published in accordance with I.C. 36-1-11-4.
The Board reserves the right to reject any and all bids or to withdraw said property from sale at any time up to the formal adoption of a resolution by the Board approving the sale to the highest and best bidder.
5. The Board may engage an auctioneer to conduct the sale by public auction. The auction may be conducted either at the time of the beginning of the sale in accordance with this Notice or after the beginning of the sale. If an auctioneer is engaged by the Board, each bidder who has submitted a bid will be given written notice of the time and place of the auction.
6. Within ten (10) days after receiving notice of the bid award, the successful bidder must deposit with the City of Gary, Department of Finance, a bid deposit in the form of a certified check, made payable to the "City of Gary", in an amount of at least ten percent (10%) of the bid amount. No extension will be granted for payment of the bid deposit.
7. Within thirty (30) days after the bid is awarded, the successful bidder must deposit with the Finance Department the difference between the bid amount and the bid deposit. An individual may apply to the Board for an extension of thirty (30) days to pay the bid amount and said extension may be granted for "good cause shown". Under no circumstance will a person be granted a longer period than sixty (60) days from the date of award within which to pay the full bid amount.
8. The City of Gary will deliver a Warranty Deed. The Deed will contain covenants forbidding sandmining.
9. The property shall be sold in an "as is" condition subject to
existing easements, restrictions of record, local, county, state and federal laws, regulations and other ordinances limiting or regulating the use of the property.
10. Prospective bidders wishing to inspect the property may arrange to do
so by contacting the City of Gary, Board of Public Works and Safety.
11. The City of Gary shall not be responsible for, or make any allowance for, damage which may occur to the property after the date of award of same to the successful bidder and will not reduce the sale price based upon any damages occurring after the award date. The successful bidder may request written permission from the Board authorizing said bidder to secure the property.
12. All persons who bid on properties being offered through the herein
described bid procedures shall be deemed to have consented and agreed to the above terms and conditions.
